Анотація
Передумови. Одним з основних прикладних питань юридичної психології є організація ефективного функціонування пенітенціарної системи, основною метою якої є соціальне моделювання поведінки людей, що скоїли правопорушення. Використовуючи парадигмальний підхід до юридичної психології та притаманний йому науковий плюралізм, можна виокремити декілька підходів до реалізації пенітенціарної функції, які потребують диференціації.
Мета. Визначити особливості реабілітаційного підходу до реформування пенітенціарної системи на прикладі американського штату Каліфорнія використовуючи парадигмальний підхід до юридико-психологічної проблематики.
Методи. Статистичний аналіз результатів виборів та кейс-стаді виборчих кампанії, зокрема виборів окружних прокурорів у штаті Каліфорнія 2020 та 2024 року, були використані для визначення основних елементів реабілітаційного підходу до реформування пенітенціарної системи, який проводився з 2020 по 2024 роки, та для оцінки рецепції цих реформ різними верствами населення.
Результати. У статті розглянуті прикладні та теоретичні аспекти реформування пенітенціарної системи в американських містах, а також визначено основні юридико-психологічні детермінанти їхньої імплементації на прикладі міста Лос-Анджелес з 2020 по 2024 роки. Розглянуто два підходи: реабілітаційний та суто пенітенціарний. Реабілітаційний підхід до системи правосуддя є більш ліберальним за своїм характером і визначає основною метою системи кримінального правосуддя реінтеграцію та реадаптацію підсудних. В той час, суто пенітенціарний напрям є більш консервативним і фокусується на самому процесі покарання. У статті охарактеризовані та визначені соціально-психологічні та індивідуально-психологічні компоненти реабілітаційного або «прогресивного» підходу до реформування пенітенціарної системи. В першу чергу, до психологічного компоненту проблематики слід віднести дослідження реакції з боку різних груп населення на імплементацію визначених реформ.
Висновки. Серед особливостей реабілітаційного реформування пенітенціарної системи у Каліфорнії можна виокремити наступні риси: пояснення джерела походження злочину екстернальними факторами; виключення фінансової складової з пенітенціарної системи для зменшення соціальної нерівності в судовій системі (між людьми різного достатку); орієнтація на реабілітаційний, радше ніж на каральний підхід; синтетичний характер запобігання скоєнню злочинів; гуманітарно-ідеологічна детермінованість підходу, яка сприяє складнощам імплементації реформ та їх реалізації на практиці.
