Анотація
Передумови. Становлення парадигмального характеру юридичної психології відбувалося в контексті інтегрального розвитку соціально-поведінкових дисциплін за рахунок взаємовпливу різних наукових напрямків, зокрема і когнітивізму, одним з основних представників якого є американський дослідник Герберт Саймон. Вчення Саймона поєднало когнітивістські та біхевіористські концепти і підходи до вивчення поведінки людини та процесу прийняття рішень, що в подальшому суттєво вплине на формування основних юридико-психологічних парадигм.
Мета. Систематизація наукового доробку Герберта Саймона у юридико-психологічній науці, що включає в себе виокремлення елементів когнітивізму, а також визначення їхнього впливу на конституювання антропологічної та клінічної парадигм юридичної психології.
Методи. У статті активно використовується структурно-функціональний метод, який допоміг визначити елементи когнітивістського підходу Герберта Саймона в контексті розвитку антропологічної та клінічної юридико-психологічних парадигм. Для актуалізації рецепції ідей Саймона, був використаних бібліометричний аналіз, який включає в себе дослідження актуальної наукової літератури, яка присвячена інтерпретації ідей Саймона та впливу когнітивізму на юридико-психологічну проблематику.
Результати. У статті розглянуті поняття «decision-making», «bounded rationality», «когнітивне обмеження», «адміністративна поведінка», що є ключовими для теорії Герберта Саймона, та активно застосовуються в юридичній психології. Послуговуючись концепцією парадигмального розвитку науки Томаса Семюела Куна, а також ідеями Ноа Хомського, з огляду на феномен «когнітивної революції», було простежено еволюцію рецепції ідей когнітивізму в антропологічній та клінічній парадигмах. Розглянутий трансформативний вплив когнітивізму Саймона на стан normal science у сфері юридико-психологічної науки.
Висновки. Ідеї Г. Саймона стали теоретичним підґрунтям для формування поняття «соціально-правової свідомості». Вчення Саймона також спирається на доробок німецької класичної філософії, що прослідковується в ідеях, котрі стосуються морально-правової автономії людини. Морально-правова автономія є складовою «адміністративної поведінки» індивіда, що розглядається Г. Саймоном в контексті процесу прийняття рішень в системі «адміністративних організацій». Теоретичний доробок Герберта Саймона в подальшому ввійде до понятійно-категоріального апарату юридичної психології з притаманними когнітивістській парадигмі епістемологічними інтерпретаціями клініцизму та антропологічної теорії.
